Licensing General

These questions and answers help clarify legal issues related to the licensing of the PHPFusion project,
and the project's basic license is released under the
GNU Affero General Public License v3
from the Free Software Foundation.
A copy of the license is included with every copy of PHPFusion, but you can also read the text of the license here.

  13. No, it will not be public record who has bought which license, but admins with proper rights can see which license is sold to a particular site to be able to check their status.
    And that information will stay within the staff that handles it, if not, the person who gives away such details will be fired from staff. We will have strictest possible confidentiality regarding licenses.

    Yes, you can, provided you only use standard solutions licensed under AGPL or similar.
  2. Can I have a site licensed under AGPL and sell custom made themes, Infusions etc from that site?
    No, you can't, due to restrictions decided by AGPL. In such a case, you need a CCL license.
  3. Can I run a commercial website under AGPL license?
    Yes, you can. But your site will be subjected to the limitations of the AGPL license to any custom codes, themes, and other derivative work. This is fine if you are not going to mod your site in any way.
  4. How does the licenses work in General terms?
    All of our proprietary licenses work according to the principle 1 domain/one licensee/for the duration of the domain/all upgrades free for life.
    It's a really good and priceworthy deal, given the contents and the longterm licenses.
    Pay once per domain and that's it.
  5. I've built up a site licensed under CCR/CCL but I wish to change the name of the domain to a better one. Can I simply transfer?
    No, you cannot. In such a case you must purchase a new license fitting your needs according to our general rules for our proprietary licenses.
  6. I've built up a very successful site and I wanna cash in on it. May I sell it? Or, may I transfer it?
    Yes, you may sell your site if you wish. You may however never sell, sublet or transfer your site licensed under PHPFusion CCR or CCL.
    The new owner must purchase a new license, since we sell our licenses based on the concept one domain/same owner/one license for the duration of the domain. This does not apply to sites licensed under AGPL
  7. If I can run a commercial website under AGPL, why would I pay for a proprietary license?
    Since all of your code modifications, alterations etc must be available for all users to download upon request according to the AGPL license.
    We've found the need for a license that revokes AGPL so that you may keep all of your modifications for yourself, without sharing them with others.
  8. PHPFusion has multiple licenses, why?
    We wish to cover as many scenarios possible for our users, that is why we have several license options.
  9. We are a group of people who wishes to purchase a CRL/CCL, how do we do that?
    You contact us in matters such as this. For legal reasons we must always have one individual representing the group on their behalf, depending on the nature of the group.
    For shareholding companies, who legally is a judicial person in itself, we must also have a specified contact person, whose details must be kept updated by the licensee.
  10. What's the deal with your proprietary licenses?
    They all revoke AGPL, making it possible for you to not share all of your own code and also not to have to display our Copyright Footer notice on your site.
  11. What's the difference between EPAL, CRL and CCL?
    Copyright Removal license - CRL gives you the right to remove our copyright notice. This license is for personal and non-commercial use only.
    Commercial Core License - CCL does exactly the same, but it is intended for commercial use.
    Enduser PHPFusion Addon License - EPAL is a license issued by PHPFusion Inc. EPAL is primarily a Developers license that we grant to Developers whom Develop and upload commercial Addons to our Addon Database.
    With EPAL Copyrights must still be visual but the user who purchase an Addon are not required to share when the site is EPAL licensed.
  12. Why have you chosen AGPL v3 as your main license?
    1: It's Open Source and it's free.
    2: While being Open Source and free, it offers the best copyright protection for the copyright holders. We find that to be of great importance.
    3: AGPL assures a steady flowback to the Open Source community, since you're free to change all you want provided you give it back to the Open Source community. It does strengthen the position of Open Source as such.

    The price level is adequate and is currently not up for any changes. However, only the future can tell in the long run.

    No, we've had AGPL for since the release of PHPFusion 7. It has served us all very well and there will be no changes in the foreseeable future.
